The Italian soccer team Juventus FC has secured its lawsuit against Brockeras s.r.l., a blockchain-powered firm hosted on Binance. The soccer team filed a lawsuit at The Court of Rome, accusing the gaming platform of producing non-fungible tokens displaying Juventus players without authorization.
Juventus FC Secure Its NFT IP Lawsuit
The Italian soccer team filed a lawsuit seeking a preliminary injunction against Brockeras Firm, a blockchain-powered platform managing online fantasy football games hosted on the crypto exchange Binance.
Juventus FC accused the fantasy game of producing NFT cards showcasing the image of its famous former player without its permission. Moreover, the NFT cards also featured several other trademarks, including the iconic black and white stripes pattern and the contracted version of the club’s name, “Juve,” typically used by fans.
The Court Of Rome’s Verdict
The Court of Rome upheld the arguments that Juventus raised and issued some orders against the defendant. The court has ordered Blockeras to withdraw the NFTs and associated digital content from the market and remove them from every website and every page directly or indirectly controlled by the same on which such products are offered for sale or advertised.
The court has ordered the defendant to provide useful information that may help identify the persons involved in the various stages of production and marketing of Brockeras NFT cards, as well as the price of Brockeras cards and the number of pieces created.
Lastly, the court has ruled that the defendant should publish the order issued in the daily newspapers, Facebook, Instagram, and Twitter for one month. The court has set a penalty of 25,000 daily for failing to implement those orders.
Juventus FC lawsuit is the first known judgment in the European region, with the court holding that NFTs reproducing a third party’s trademarks without authorization are infringing and hence granting a related injunction.
